Doctor-medic Otilia GudanaPsychiatric expert opinions

General terms and conditions

Terms for medical expert opinions and further services of the practice of Doctor-medic Otilia Gudana.

1. Scope

These general terms and conditions apply to all contracts for medical expert opinions, specialist statements and advisory services between the private practice of Doctor-medic Otilia Gudana (the "practice") and its instructing parties (the "client"). Deviating terms apply only with express written confirmation.

2. Formation of the engagement

The expert opinion engagement is formed by written or text-form instruction and acceptance. Before work begins, the parties conclude a written fee agreement. The practice bills exclusively on a private basis; no billing with statutory health insurance funds takes place.

3. Scope of services

The practice provides services in the field of psychiatric and psychosomatic expert opinions, statement psychological assessment and method-critical reviews. The assessment follows recognised medical and scientific standards and the relevant guidelines. A particular outcome of the opinion is not owed.

4. Remuneration and billing under the GOÄ

Medical services are billed according to the German Medical Fee Schedule (GOÄ) as amended. The standard rate applies; in cases of increased difficulty or time expenditure, a higher multiplier may be applied, which is shown transparently on the invoice.

On request, the practice provides a cost estimate in advance. Individual fee agreements under section 2 GOÄ remain unaffected.

5. Medical expert opinions

Expert opinions are billed, depending on the client, under an individual fee agreement or under the Judicial Remuneration and Compensation Act (JVEG). For private-law instructions (e.g. insurers, law firms, companies, private individuals), the fee is agreed in writing before work begins; advance payments are permissible. Court appointments are governed by the JVEG.

Expert opinions are scientifically founded expert services. A particular outcome is not owed and cannot be the subject of a reduction in remuneration.

6. Payment terms

Invoices are payable without deduction within 14 days of receipt. In the event of late payment, default interest is charged under section 288 BGB. The practice is entitled to charge reminder fees according to effort.

7. Appointment cancellations and default fees

Examination appointments are binding. A cancellation or rescheduling is effective only if it reaches the practice no later than 24 hours before the agreed appointment. The receipt of the cancellation at the practice during usual availability hours is decisive; declarations received outside these hours are deemed received on the next working day.

If an appointment is not cancelled in time or not attended, the practice retains its claim to remuneration under section 615 BGB (default of acceptance). Expenses saved within the meaning of section 615 sentence 2 BGB are deducted. The client remains free to prove that the practice suffered no or lesser damage.

The claim to remuneration does not apply in the following exceptional cases, provided they are reported without delay and, on request, made credible:

  • sudden, unforeseeable acute illness that makes attendance unreasonable;
  • an accident involving the person to be examined;
  • unforeseen inpatient admission;
  • force majeure (e.g. natural events, officially ordered restrictions);
  • the practice being unreachable for a timely cancellation for reasons attributable to the practice;
  • a mutually agreed rescheduling of the appointment before the 24-hour deadline expires.

For expert opinion appointments, the respective individual fee agreement applies; its provisions on cancellations, default and advances take precedence over the above.

8. Cooperation of the client

Proper assessment requires the cooperation of the client. This includes in particular: complete and truthful information on the question at issue, the provision of relevant documents and prior findings, and adherence to the agreed appointments.

9. Termination of the engagement

The engagement may be terminated by either party at any time (section 627 BGB). Services already rendered are to be remunerated.

10. Data protection and confidentiality

The practice is subject to medical confidentiality (section 203 StGB) and the code of professional conduct. Personal data and health data are processed exclusively in accordance with the GDPR and the BDSG. Details can be found in the privacy notice.

11. Final provisions

German law applies. The place of performance is Munich. The place of jurisdiction for merchants within the meaning of the HGB is Munich; for consumers, the statutory provisions apply. The practice does not participate in dispute resolution proceedings before a consumer arbitration board. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.

As of: 2026.
